Marijuana Grow Houses, Cocaine, all other forms of illegal narcotics. The Canadian Charter of Rights and Freedoms provides the right to be free from unreasonable search and seizure and arbitrary detention. In some cases to be successful one must exclude from evidence the drugs that were seized by way of utilizing an illegal search and seizure defence. Alternatively, there may be issues with possession which requires knowledge, consent and control to prove possession.
These types of cases are often defended either on a very technical basis or also utilizing the Canadian Charter of Rights and Freedoms. A client should always be advised of every option available in each case including an understanding of minimum mandatory sentences.
Weapons and Firearms Offences
There are now minimum mandatory sentences for some firearm offences. Defences in these cases can range from lack of proof of possession or illegal search and seizure or other case specific defences.
Fraud, Theft Offences
In many cases fraud and/or theft may be difficult cases for the prosecution to prove beyond a reasonable doubt. Defences are very case specific. If these cases are made out by the prosecution there is often, under certain circumstances, the availability of a conditional sentence (which is a jail term to be served at home with certain exceptions)
